Villages and Vineyards, LLC (also referred to as Villages and Vineyards in this document) values your privacy and your personal data.  This Villages and Vineyards Privacy Policy describes the types of personal data that Villages and Vineyards may collect and/or receive from you, how we may use, store, disclose, share and transfer that personal data, and how you may exercise any rights you may have regarding our processing of your personal data.

Villages and Vineyards relies on the following legal basis for processing your personal data:

  • Performance under a Contract (Our Terms of Service and Privacy Policy): most of the personal information we process is necessary for us to perform our obligations under a contract we have with you, and if applicable, your employer when you receive the Service as an employee benefit.You agree to our Terms of Service and Privacy Policy when you use our website and when you submit a booking.

  • Legal Obligations: there are many laws that require us to process your personal data in accordance with existing laws.

  • Legitimate Interest: we have a legitimate interest in processing some of your personal information in some circumstances. We will only process your personal information if our legitimate interests do not override your fundamental rights, freedoms and interests.

 

Types of Personal Data that May Be Collected and/or Received

When you visit the Website and/or book one of our Tours or Services we may collect personal data. This includes, but is not limited to:

  • Physical characteristics discerned from photos and other physical characteristics such as your height and inseam necessary for proper sizing of a bicycle, and any accident/illness report information and other medical and health records that may be necessary to discuss as part of your participation in a tour;

  • Location information, including that provided by a mobile or other device;

  • The website from which you visited us;

  • The type of browser you used to access the Website;

  • The date and duration of your visit to the Website;

  • Purchase history with us;

  • Username and Password, if applicable.

 

Personal data is collected and/or received when, but not limited to:

  • You utilize our website via your browser’s cookies;

  • You subscribe to our email list for newsletters or other marketing communication materials;

  • You request or purchase products, services, or other information from us, when you visit or shop with Villages and Vineyards online or use its online services;

  • You voluntarily complete a customer survey or provide feedback via email;

  • You book one of our trips;

  • You participate in one of our trips;

  • You click on one of the social media links in our website;

  • You create an account at our website;

  • You reach out to us with a question or comment;

  • You apply for employment with us.

 

For the purposes indicated above, we will process personal data we receive from you and some of which is consistent with public and commercial databases (already in the public domain).

 

When you provide us with your personal data by visiting our website and/or buying our goods and services, you consent for us to process your personal data and serve the requests you may make of Villages and Vineyards. If mandated by applicable law and you have not otherwise provided us with consent, we attempt to take good faith efforts to inform you where we require your consent to process your personal data. Otherwise, we will process your personal data to meet our legitimate business interests (including maintaining contact with clients, providing updates and information about Villages and Vineyards, organizing and hosting events, and conducting market research and analysis) or where it is needed to comply with a legal obligation. In addition, we may also process your personal data to enter into a contract with you, or to perform our obligations under an existing contract with you. Our Terms of Service and Privacy Policy are considered contracts and in force when you use our website and/or purchase our goods and services.

 

Children’s Information

The Website is meant for adults and those who have reached the age of majority as defined by the laws of their domicile. The Website is not meant for individuals under the age of eighteen (18) or those defined by the laws of their domicile as minors. Nonetheless, this Privacy Policy is still designed to comply with the Children’s Online Privacy Protection Act (“COPPA”) to the extent COPPA and/or the California Consumer Privacy Act (“CCPA”) and/or the General Data Protection Regulation (“GDPR”) apply. Accordingly, we do not knowingly collect or retain any personal information about users under the age of sixteen (16). If we obtain actual knowledge that we collected or retained personal information about a child under the age of sixteen (16), that information will be promptly deleted from our database, servers, and all other media. Since we do not collect information from users under sixteen (16) years of age, no such information is disclosed to third parties.

 

If parents or guardians wish to create an account for, and/or provide information related to their child who is under the age of eighteen(18), the parent or guardian may do so, but assumes full responsibility for ensuring that the information is kept secure and that the information submitted is accurate. In providing such information, the parent or guardian accepts that this Privacy Policy will apply to the minor child’s information.

Please note that changing your opt-out preference will only affect future activities or communications from us. By booking a tour with Villages and Vineyards, you are expressly authorizing Villages and Vineyards to collect, store, disclose, use, share, transfer, and otherwise process any information relating to you, or which, either alone or when combined with other data, may be used to identify you in accordance with this Privacy Policy. This authorization applies to all participants included on the booking.

 

You acknowledge that Villages and Vineyards will be required to disclose, share, and/or transfer some of your personal data to its employees, agents, representatives, contractors, and suppliers as deemed necessary by Villages and Vineyards for the proper management and execution of the tours and related services.  This includes, but is not limited to, hotels, transport providers, concert venues, local city tour providers, and other service providers required for the execution of the tour(s).

 

Non-health related personal data may also be disclosed, shared, and/or transferred to other tour participants for communication during and after the tour(s).

 

You acknowledge and agree that Villages and Vineyards may use and disclose your personal and non-personal information to public or private third parties: (i) to comply with requests for inspection by law enforcement officials (including potential criminal activity); (ii) to respond to cease and desist letter, arbitration proceedings, legal actions and suits, criminal and civil subpoenas, or any court orders; (iii) to enforce or apply the terms of this Privacy Policy or any other agreement between us, including, the Terms of Service; and (iv) to protect our rights, property, or safety, as well as the rights, property, or safety of our users, or others, whether during or after the term of your use of the Website or any services.

 

Villages and Vineyards may provide your personal data to health care providers and facilities, including but not limited to hospitals, clinics, doctors, nurses, and ambulance services involved in providing your care in connection with health-related events or other emergencies that occur during the course of the tour.

We seek to ensure that your personal data is processed in a manner that is compatible with the purposes specified in this Privacy Policy. For the specified purposes, your personal data may be disclosed to the following parties who operate as third-party data controllers:

  • Other Villages and Vineyards related companies;

  • Lodging, transportation, and activity providers.

For instance, Villages and Vineyards may raise or waive legal objections or rights. Such disclosure may occur, but is not limited to, disclosing your information in connection with efforts to: (i) investigate, prevent, or commence other actions regarding suspected illegal activity or other wrongdoing; (ii) protect or defend the rights, property or safety of our company, our users, our employees, or others; (iii) comply with applicable law or cooperate with law enforcement; or (iv) enforce the Terms of Service or other agreements or policies between you and us related to the Website or Services.

 

Transfer of Personal Data Across National Borders

Please be aware that personal data we collect and process may be transferred and maintained in the United States, and/or France and/or Germany and outside your state, province, country, or other jurisdiction, where the privacy laws may not be as protective as those in your home location.

Villages and Vineyards has put in place safeguards, in accordance with applicable legal requirements, to protect your personal data irrespective of the standards in the country where your personal data may be transferred. This includes entering into agreements with third parties, such as service providers, to require them to adopt standards that ensure an equivalent level of protection for data as those we adopt.

Consistent with applicable laws and requirements, Villages and Vineyards has put in place physical, technical, and administrative safeguards designed to protect personal data from loss, misuse, alteration, theft, unauthorized access, and unauthorized disclosure.  However, as is the case with all websites, applications, products, and services, we unfortunately are not able to guarantee security for data collected through our websites, applications, Products and Services.

 

Your Rights Regarding Your Personal Information

Subject to applicable data protection law, you may have a right to some or all of the following with respect to your personal data:

  • To revoke or reject in writing a personal data disclosure authorization at any time, but in no event later than thirty (30) days prior to the scheduled tour start date, and specifically state the type of information that may not be further disclosed.You may also revoke in writing at any time a disclosure authorization for further dissemination that may occur after the conclusion of the tour (including under EU GDPR Article 21).

  • To request access to your personal data (including under EU GDPR Article 15);

  • To request that we rectify or erase your personal data (including under EU GDPR Articles 16 and 17);

  • To object to the processing of your personal data (including under EU GDPR Article 21);

  • To request that we restrict or block the processing of your personal data (including under EU GDPR Articles 18, 21 and 22);

  • To provide your personal data directly to another, i.e., a right to data portability (including under EU GDPR Article 20); and

Marketing and Promotional Emails

You may unsubscribe from any marketing or promotional emails. To do so, please email us at info@villagesandvineyards.com or use the unsubscribe mechanism offered in our marketing emails or other communications, as applicable. Please note that if you already have requested our Products or Services when you decide to withdraw consent, a short period of time may elapse before we can update your preferences and ensure that we honor your request.

 

How Long Your Personal Information Will Be Retained
